Please read these terms carefully. By downloading, installing, or using the GetBetter. app or website, you agree to be bound by these Terms of Use and End User License Agreement ("Agreement"). If you do not agree, do not use the app.
1. Acceptance of Terms
This Agreement is between you ("User," "you," or "your") and GetBetter. ("GetBetter," "we," "us," or "our"). It governs your access to and use of the GetBetter. mobile application, website, and all related services (collectively, the "Service"). By creating an account or using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into this Agreement.
2. License Grant
Subject to your compliance with this Agreement, GetBetter. grants you a limited, non-exclusive, non-transferable, revocable license to download and use the GetBetter. app on any iOS device that you own or control, solely for your personal, non-commercial use.
3. Restrictions
You agree that you will not:
- Copy, modify, or distribute the app or any portion of it
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app
- Use the Service for any commercial purpose without our express written consent
- Use automated scripts, bots, or scrapers to access the Service
- Attempt to spoof your location to fake geo check-ins
- Share your account credentials with others
- Use the Service to harass, abuse, or harm other users
- Post content that is illegal, defamatory, obscene, or infringes on third-party rights
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
4. Account Registration
You must create an account to use most features of the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at nickyshanker@getbetterbrand.com if you suspect unauthorized access to your account.
5. Geo Check-In and Location
The Service uses your device location to verify attendance at participating studio locations. By using the check-in feature, you consent to the one-time collection of your location at the time of each check-in. Attempting to falsify location data to fraudulently earn rewards is a violation of this Agreement and may result in immediate account termination and forfeiture of all accumulated rewards.
6. Rewards Program
GetBetter Bucks (GBB) are earned through verified check-ins and challenge completions. GBB have no cash value and may only be redeemed for the specific reward tiers offered within the app. GetBetter. reserves the right to modify, suspend, or terminate the rewards program at any time with 30 days' notice. Accumulated GBB will not be forfeited without reasonable notice except in cases of fraud or violation of this Agreement. Rewards are subject to availability and partner terms.
7. User Content
You may post photos, comments, reactions, and other content ("User Content") to the social features of the Service. You retain ownership of your User Content. By posting User Content, you grant GetBetter. a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content solely in connection with operating the Service. You represent that you have the rights to post any content you submit and that it does not violate any third-party rights.
GetBetter. reserves the right to remove any User Content that violates this Agreement or that we deem harmful to the community, at our sole discretion.
8. Studio and Instructor Accounts
Studios and instructors may access additional features including challenge creation tools and attendance analytics. By activating a studio or instructor account, you represent that you have the authority to bind the studio to this Agreement. Studio accounts are subject to additional terms provided at onboarding.
9. Third-Party Services
The Service integrates with third-party services including but not limited to gift card providers and fitness booking platforms. Your use of those services is subject to their own terms and privacy policies. GetBetter. is not responsible for the acts or omissions of third-party service providers.
10. Intellectual Property
The GetBetter. name, logo, wordmark, app design, and all associated intellectual property are owned by GetBetter. and are protected by applicable intellectual property laws. Nothing in this Agreement grants you any right to use GetBetter.'s trademarks, logos, or brand elements without our prior written consent.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GETBETTER. DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GETBETTER. AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL GETBETTER.'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GETBETTER. IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.
13. Indemnification
You agree to indemnify, defend, and hold harmless GetBetter. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your User Content, or your violation of this Agreement.
14. Termination
Either party may terminate this Agreement at any time. You may terminate by deleting your account. GetBetter. may suspend or terminate your account immediately if you violate this Agreement. Upon termination, your license to use the app ends and accumulated rewards may be forfeited in cases of fraud or misconduct. Sections 10–16 survive termination.
15. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
16. Changes to This Agreement
We may update this Agreement from time to time. We will notify you of material changes via in-app notification or email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Agreement.
17. Apple App Store Additional Terms
If you downloaded the app from the Apple App Store, you acknowledge that: (a) this Agreement is between you and GetBetter. only, not Apple; (b) Apple has no obligation to provide maintenance or support for the app; (c) Apple is not responsible for any product liability claims; (d) Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
